Welcome to PhotoNexAI ("we," "our," or "us"). We are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application (the "App"). Please read this policy carefully. If you do not agree with the terms of this privacy policy, please do not access the App.

We collect information that identifies, relates to, describes, or could reasonably be linked to you.
A. User-Provided Information
Photos and Facial Data: To provide our core AI-powered photo editing and generation features, we require access to the photos you upload. We may process "Facial Data" (including facial geometry and landmarks) to apply AI filters and generate avatars.
Account Information: If you create an account, we may collect your name, email address, and login credentials.
B. Automatically Collected Information
Device and Usage Data: We automatically collect your IP address, device type, operating system version, device identifiers (such as IDFA or AAID), and app usage statistics to ensure the App functions correctly.
C. Third-Party Data We may receive information from third-party services, such as analytics providers (e.g., Google Analytics for Firebase) and advertising networks (e.g., Google AdMob).

We use the collected information for the following purposes:
To Provide AI Features: To process your photos and Facial Data solely to generate the requested AI edits or avatars.
To Improve Our App: To analyze usage trends, troubleshoot bugs (via Firebase Crashlytics), and improve user experience.
To Serve Advertisements: To display relevant ads through third-party ad networks.
Customer Support: To respond to your inquiries and support requests.

Important Note on AI Training: The photos and facial data you upload are used exclusively for the purpose of generating your requested avatars. We do not use your personal photos, generated avatars, or facial data to train, retrain, or improve our foundational AI models.

We practice strict data minimization. We only keep your data for as long as it is necessary.
Photos and Facial Data: Original photos and Facial Data uploaded for AI generation are automatically permanently deleted from our servers within a few minutes after the editing process is complete. We do not store Facial Data long-term.
Generated AI Images: Images generated by the App are stored locally on your device or linked to your account.
Account Information: Retained until you request account deletion.

We do not sell your personal data. We may share your information only in the following circumstances:
Service Providers: With trusted cloud computing platforms (e.g., AWS, Google Cloud) that host our servers and process data securely on our behalf.
Ad Networks & Analytics: With third-party ad partners (e.g., AdMob) and analytics tools to deliver personalized ads and track performance.
Legal Requirements: If required by law, subpoena, or government request to protect our legal rights or the safety of our users.

You have full control over your data. You can delete your account and all associated data at any time.
Email us at contact@photonexai.com with the subject line "Data Deletion Request," and we will fulfill your request within 15 days.

A. European Economic Area (GDPR) and UK Users If you are located in the EEA or the UK, you have the right to access, rectify, erase, restrict processing of, or export your personal data. We rely on your consent and our legitimate business interests as the legal bases for processing your data.
B. California Residents (CCPA/CPRA) If you are a California resident, you have the "Right to Know" what personal information we collect, the "Right to Delete" that information, and the "Right to Opt-Out" of the sale or sharing of your data. PhotoNexAI does not sell your personal data to third parties.
C. Illinois Residents (BIPA) and Biometric Privacy While we process Facial Data to create AI images, we do not use this data to identify you or authenticate your identity. Any extracted facial geometry is used transiently and destroyed immediately after the image generation is complete, in strict compliance with the Biometric Information Privacy Act (BIPA).

Depending on your location (such as the EEA, UK, or California), you may have certain rights regarding your personal data. These include the right to:
Access the personal information we hold about you.
Request the correction of inaccurate data.
Request the deletion of your data.
Object to our processing of your data.

PhotoNexAI is not intended for use by children under the age of 13 (or the applicable age of digital consent in your region). We do not knowingly collect personal information from children. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately at support@photonexai.com. If we become aware that we have collected personal data from a child without parental consent, we will take immediate steps to delete that information from our servers.

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of any material changes by updating the "Effective Date" at the top of this document or via in-app notification.
